Hearing of Justice Qazi Faiz Essa case adjourned till Monday

ISLAMABAD: Attorney General of Pakistan on Tuesday submitted a response on Justice Qazi Faiz Essa petition against the action of the Supreme Judicial Council against him in the Supreme Court.

The 10-member larger bench of Supreme Court (SC) headed by Justice Umar Atta Bandial heard the petition against Supreme Judicial Council action against Justice Qazi Faiz Essa and Justice K Agha.

Attorney general excused for submitting reply late while Muneer Malik, the counsel of Justice Qazi Faiz Essa said the reply didn’t include allegations of malignity adding that honourable judge and his family have been spied in the reference filed against him in the supreme judicial council.

Justice Umar Atta Bandial said, “Inform the court with the background of the case how the honourable judge insulted” while Muneer Malik said that deliberately a campaign was launched against his client adding that his client gave a verdict which didn’t like by the administration and after the verdict a well-planned campaign was launched against him which was tantamount to a trial of the whole judiciary.

Justice Umar Atta Bandial remarked that “due to objection raised by you two of judges of the bench left the bench which was a painful act while it is also important for the institution we have to review the presented record.”

He further asked, “Are the allegations levelled in the presidential reference false? While the presidential reference gives the impression that properties were made with malafide intentions while we can not a bury matter of making properties.”

Over insistence of adjourning the case for up to two weeks, Justice Umar Atta Bandial said that we wanted early hearing of the case we all are sitting here for hearing of the case” We are here to hear cases. Let us know if you want a prolonged deferment of the case,” he said. The head of the bench further said that an “honourable friend” from his “community” has been accused so the bench wants to hear out the matter post-haste.”

Raza Rabbani requested the court his petition must be heard, to which, Umar Atta Bandial said that “we will hear your petition after hearing central petitioner counsel.

Another consul of the case Rasheed A Rizvi said that the court has been neglecting as many as 15 petitioners to which Justice Umar Atta Bandial said that it is not a cake that all of them will be served with it, it is a case which we have to hear.

The court rejecting one of petitioner request to adjourn the case for two weeks adjourned the hearing till coming Monday. (With additional input from INP)
